Takeaways from AI Act and Automated Decision Making:
The proposed European AI Act aims to be a comprehensive regulation of artificial intelligence applications and emphasizes risk-based regulation. AI applications have become an increasingly critical part of automated decision-making processes; Biden’s Executive Order and G7 Principles serve as excellent examples. Automated decisions, as defined by the General Data Protection Regulation, (GDPR), are those that are made without human involvement.
These developments reflect an international push toward developing frameworks to enable ethical and secure deployments of AI technologies.
Data Protection & Intellectual Property:
GDPR regulations already establish standards for AI-generated data. Intellectual property rights also play a significant role when applied to generative AI for product development purposes. A key takeaway was to evaluate whether personal data was involved in AI processes and, if so, to ensure compliance with GDPR obligations such as minimization and lawful basis of processing under GDPR obligations.
Risk-Based Approach:
The session provided an in-depth breakdown of how the AI Act addresses risk, categorizing AI systems into banned, high-risk, and transparent categories; with transparent systems requiring clear disclosure of content produced by AI. High-risk systems that could harm health or fundamental rights will face stringent regulations with potentially hefty fines attached.
Within AI Value Chain: Division of Labor
The webinar provided clarity into the AI value chain from foundation model providers down through downstream system providers and end-users. Shima Abadi, an AI lawyer, emphasized the importance of understanding where one falls in the AI value chain, as different roles come with varying obligations. Under AI Act there will be separate obligations on all entities within that value chain including internal users who utilize AI systems.

To arm a lawyer friend with an AI assistant that could sift through case law with the precision of a seasoned barrister. This wasn’t just any assistant; it was like crafting a bespoke suit, tailored to the intricacies of legal strategy and objection forecasting.
In my digital toolkit, I found two plugins that were to legal research what a gavel is to a judge – the US Federal Law and midpage caselaw. With these, and the Linkreader as my trusty sidekick, I could traverse the vast legal landscape, ensuring no stone was left unturned.
By mid-morning, I found myself in the all-too-familiar setting of a clinic, awaiting an MRI. The wait was longer than a filibuster, so I turned to my phone and dove back into the world of ChatGPT. The plugin count had exploded, from a modest gathering to a veritable digital metropolis. The growth was exponential, a testament to the ingenuity of developers and the insatiable curiosity of users like myself.
Among the plethora of specialized GPTs, I encountered one for Canva and thought, “Why not?” So, I asked the AI to whip up a lawyer meme, because who doesn’t love a good chuckle at the absurdity of client relationships? It was so spot-on, I duplicated it, flipped it, reversed it, and made it even funnier. It was easier than putting socks on a rooster.
The array of GPTs was as varied as the law itself. There was DALL·E, an artist turning concepts into visuals, and the Negotiator, ready to strategize like a seasoned litigator. For those moments of writer’s block, the Creative Writing Coach offered guidance, while the Tech Support Advisor stood ready to troubleshoot with the patience of a saint. I did encounter one irritant, you couldn’t use those magical plugins with the Specialist GPTs. Hope they remedy that soon.
After the day’s appointments, I returned home to find ChatGPT taking an unexpected recess – the system had crashed, a rare hiccup in the digital court of public opinion. Yet, before the downtime, I had managed to conduct some substantial research. Thank God for Bard – who is a masterful backup.
The next day brought a new beginning and a fresh login. With the results of my MRI in hand, I challengesd ChatGPT to channel a leading surgeon’s expertise. The AI responds with digital empathy, translating medical speak into a clear narrative, offering a level of patient understanding and interaction as impressive as securing more than five precious minutes with a real-life doctor. Patiently addressing every follow-up question without a hint of haste.
As I reflect on the day’s adventures and let ChatGPT peruse my narrative, I’m filled with anticipation for the future applications of this technology. It’s a brave new world for the legal profession, and I’m ready to meet it with a smile and a savvy AI assistant by my side. Now, if only ChatGPT could serve coffee during those early morning case reviews.
